Bayer has already agreed to have to pay $11 billion in personal injuries settlements and trial verdicts amid claims that the product causes non-Hodgkin's Lymphoma. Although the stock price has plummeted, a trial victory boosted its value in the latter part of 2021.

Bayer, which sells Roundup, has been the subject of around 125,000 lawsuits. This is despite the fact that Roundup is a well-known and popular weed killer. Bayer bought Monsanto in 2018, the company that developed Roundup in the 1970s. The company has been plagued by legal problems ever since.

Roundup claims that glyphosate (a chemical found in the product) is carcinogenic. The Roundup lawsuits claim that Bayer failed to warn consumers about the dangers and that the product is dangerous. The company has settled around 100,000 lawsuits to date. However, two trials were won by Bayer last year, which suggests a shift in future claims.

Bayer argues that the Environmental Protection Agency doesn't consider glyphosate carcinogenic. The EPA believes there is no evidence that the chemical causes cancer. Therefore, they deemed it unnecessary to warn Roundup users. Bayer has cited Bayer and other environmental and health agencies who believe glyphosate to be safe in all aspects of their defense.

Bayer was pleased with the Supreme Court's decision not to include the Biden administration. Many believe that it is a sign the justices are inclined to hear the cases. With Bayer's recent victories at trial, their defense might hold up at the highest court. Bayer stated that there is no basis for "failure-to-warn" claims, as the EPA did not prevent Roundup labels from being used for cancer warnings.
